The Commodity Futures Trading Commission (CFTC) has formally requested a federal judge to throw out a lawsuit initiated by CME Group. The dispute centers on the regulatory environment for digital asset perpetual futures, a product class currently seeing high demand.

In its filing, the CFTC characterized the litigation as unnecessary. The regulator maintains that its existing orders already grant designated contract markets—including CME—the legal authority to list and trade these specific derivative products.

The agency contends that there is no regulatory ambiguity hindering CME’s ability to move forward. By labeling the suit as "much ado about nothing," the CFTC is signaling that the legal hurdle is based on a misunderstanding of current market permissions.

Market participants are watching the court’s response closely, as the outcome could set a precedent for how traditional exchanges introduce crypto-native products without enduring protracted regulatory friction.
